Eligibility Requirements for U-Visa

Application Process for U-Visa

  1. Form I-918:
    The applicant must file Form I-918, Petition for U Nonimmigrant Status, along with Form I-918 Supplement B, which is a certification from law enforcement confirming the victim’s cooperation.
  2. Review and Approval:
    USCIS reviews the petition and supporting documentation. If the U-Visa is granted, the applicant can stay in the U.S. for up to 4 years, with the possibility of extension.
  3. Work Authorization:
    U-Visa holders are eligible to apply for a work permit and can apply for permanent residency (green card) after 3 years of continuous presence in the U.S.
